Customs Notification No-27/2005 dated 02.03.2005
Amendments in the various customs notifications

G.S.R 148 (E). - In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby directs that each of the notifications of the Government of India in the Ministry of Finance (Department of Revenue) specified in column (2) of the Table below shall be further amended in the manner as specified in the corresponding entry in column (3) of the said Table, namely :-

1. 34/1997-Customs dated, the 7th April, 1997. In the said notification, in paragraph 2, in condition (vi), for the words “the exemption from the duty specified in the First Schedule to the said Customs Tariff Act” the words “the exemption from the said duty” shall be substituted.
2. 45/2002-Customs, dated the 22nd April, 2002. In the said notification, in paragraph 3, in condition (v), for the words “the exemption from the duty specified in the First Schedule to the said Customs Tariff Act” the words “the exemption from the said duty” shall be substituted.
3. 96/2004-Customs, dated the 17th September, 2004. In the said notification, in condition (v), for the words “the exemption from the duty specified in the First Schedule to the said Customs Tariff Act”, the words “the exemption from the said duty” shall be substituted.
4. 97/2004-Customs, dated the 17th September, 2004. In the said notification, in paragraph 2 for condition (3) and the entries relating thereto the following condition and entries shall be substituted, namely,- “(3) that if the importer does not claim exemption from the additional duty leviable under section 3 of the Customs Tariff Act, 1975, the additional duty so paid by him shall not be taken for computation of the net duty saved for the purpose of fixation of export obligation provided the Cenvat credit of additional duty paid has not been taken;”.

Note : 1. Notification No.34/97-Custom, dated the 7th April, 1997 was published in the Gazette of India, Extraordinary Part II, Section 3, sub-section (i) vide G.S.R. 197 (E), dated the 7th April, 1997 and was last amended by notification No.95/2004, dated the 15th September, 2004 published vide GSR 614 (E) dated 15th September, 2004.

Notification No.42/2002-Customs, dated the 22nd April, 2002 was published in the Gazette of India, Extraordinary Part II, Section 3, sub-section (i) vide G.S.R. 298 (E), dated the 22nd April, 2002 and was last amended by notification No.95/2004, dated the 15th September, 2004 published vide GSR 614 (E) dated 15th September, 2004.

3. Notification No. 96/2004-Customs, dated the 17th September, 2004 was published in the Gazette of India, Extraordinary Part II, Section 3, sub-section (i) vide G.S.R. 619 (E), dated the 17th September, 2004.

4. Notification No. 97/2004-Customs, dated the 17th September, 2004 was published in the Gazette of India, Extraordinary Part II, Section 3, sub-section (i) vide G.S.R. 620 (E), dated the 17th September, 2004.
