Amendments in the notification regarding Prohibiting import of counterfeit trademark goods

G.S.R.332 (E). - In exercise of the powers conferred by section 11 of the Customs Act, 1962 (52 of 1962), the Central Government being satisfied that it is necessary in the public interest so to do, for the purposes specified in sub-section (2) of that section; hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance, Department of Revenue No.1/64-Customs, dated the 18th January, 1964, namely:-

In the said notification,-

(i) clauses (iii),(iv) and (vii) shall be omitted;

(ii) in clause (viii), for the words and figures “ section 117 of the Trade and Merchandise Marks Act, 1958,” the words and figures “ section 139 of the Trade Marks Act,1999” shall be substituted;

(iii) in clause(ix), in sub-clause (b), for the words and figures “ section 75 of the Trade and Merchandise Marks Act, 1958,” the words and figures “ section 82 of the Trade Marks Act,1999” shall be substituted;

(iv) in clause (x), in sub-clause (b), for the words and figures “ section 75 of the Trade and Merchandise Marks Act, 1958,” the words and figures “ section 82 of the Trade Marks Act,1999” shall be substituted.

Note:- The notification No 1/64-Customs dated the 18th January, 1964 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide GSR 87 dated the 18th January, 1964 and was amended by notification No 61/2000-Customs (NT) dated the 10th October,2000 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) dated the 10th October,2000.
