PUBLIC NOTICE NO.   27   (RE-2005)/2004-2009 dated 14.7.2005
Export of Sandalwood Chip Classes

            Attention is invited to the Item Code No. 1211 90 50 under Sl. No. 153 of Chapter 44 in Schedule 2 of the Book Titled ‘ITC (HS) Classifications of Export and Import Items, 2004-2009, as amended from time to time. 

 2.      In exercise of the powers conferred under paragraph 2.4 of the Foreign Trade  Policy 2004-2009, the Director General of Foreign Trade hereby allocates a quantity of 1600 MT of "Sandalwood Chip Classes" for the export of the licensing year 2005-2006 and specifies the conditions and procedures to be followed in respect of sandalwood in the form of heartwood chips (upto 50 gms), mixed chips (upto 30gms), flakes (upto 20 gms) of the sandalwood classes (Jajpokal I Class, Jajpokal II Class, Antibagar, Cheria, Milvachilta, Basolabukni, Saw dust, Charred billets), sandalwood powder/dust/chips/flakes obtained as waste after the manufacturing process and sandalwood in any other form as approved by the  Exim Facilitation Committee in the Directorate General of Foreign Trade. 

 3.       All such exports shall be permitted only against an Export Licence to be issued by the Director General of Foreign Trade. The export licence shall be issued as per decision of the Exim Facilitation Committee in the DGFT (Hqrs) and shall be valid for one year from the date of issue.  No further revalidation of such licence shall be allowed.  

 4.     The following procedures for obtaining an export licence shall be followed by the exporters of the sandalwood chips: 

(i)                  Prospective exporters shall submit their application in Aayaat Niryaat Form to the DGFT (Headquarters Office), Udyog Bhavan, New Delhi-110011.

 (ii)                The application shall be accompanied by the following documents:- 

(a)    A copy of the valid export order/irrevocable Letter of Credit from the foreign buyer; 

(b)    Exporters should submit a copy of Legal Procurement Certificate(s)/Certificate of Origin in their name issued by the Principal Chief Conservator of Forests of the concerned State  that Exporter/s himself/themselves must have purchased Sandalwood strictly in the  

auction conducted by the State Government in the format as prescribed at Annexure I to this Public Notice.  

(c)    A copy of Certificate of Physical Verification from the Regional Deputy Director (Wildlife), Delhi, Chennai, Kolkatta and Mumbai or from the DCF/DFO of the concerned Division.  The Physical Verification Report must be duly supported/mentioned with the transit permit.  The unexported materials against the licence obtained but lying in premises/godowns of the firm must also be inspected at that time and must be duly reflected in the Physical Verification Report.   

(d) At the time of issue  of permission, the exporters shall produce the Original Legal Procurement Certificate and Certificate of Physical Verification complete in all respects of Sandalwood classes to D.G.F.T., Udyog Bhavan, New Delhi –110011 for  verification.  

5.         Application   received    would be considered by the Exim Facilitation Committee on merits  for issue of Export Licences  for export of  said items  and shall   be  subject to any other condition including the conditions of :                                   

(a)    Quantitative ceilings 

(b)    Minimum Export Price 

(c)    Size/weight stipulations in respect of heartwood chips not exceeding 50 gms., mixed chips not exceeding 30 gms and flakes not exceeding 20 gms of the sandalwood classes (Jajpokal I Class, Jajpokal II Class, Antibagar, Cheria, Milvachilta, Basolabukni, Saw dust, Charred billets). 

(d)    Sandalwood dust/powder/chips/flakes obtained as waste after the manufacturing process, may be permitted for export under licence by manufacturer exporters of value added sandalwood handicrafts products and machine finished goods subject to a quantitative ceiling and such other conditions as may be prescribed. 

 6.        Applicants who have applied in terms of    earlier   Public Notice No.46 (RE-2001)/1997-2002, dated 05.11.2001 should apply afresh, as per above procedure, with   reference to this Public Notice.
